Contractors seeking registration and pre-qualification must demonstrate that the following requirements have been satisfied. In addition, the contractor's nominated sub-contractors must also demonstrate that the requirements set out below for Quality, Safety and Environmental Management Systems have been satisfied. Irrespective of registration and pre-qualification status, successful tenders for the Council's contract works must satisfy any specific contract requirements in respect to the following requirements. |

| INSURANCE AND WORK COVER | |
|
It is a requirement of each contract for the contractor to take out a Public Liability Policy of Insurance in the joint names of the Frankston City Council, the contractor and all sub-contractors employed in relation to the works for the amount set out in the Tender Documents. The Policy must include a cross-liability clause in which the insurer agrees to waive all rights of subrogation or action that it may have or acquire against all or any of the persons comprising the insured and for the purpose of which the insurer accepts the term "insured" as applying to each of the person comprising the insured as if a separate policy of insurance has been issued to them (subject always to the overall sum insured not being increased thereby). Details of the contractor's current insurance policies must be included in the application for registration and pre-qualification, together with evidence that the contractor is registered as an employer for the purposes of the Accident Compensation Act 1985. If it is not feasible to submit a copy of the policies with the application, the contractor must have its insurer complete the statement of insurance contained in the application forms indicating that in the event of the contractor being awarded a Council contract, the insurer will comply with the provisions of the contract. |

| QUALITY SYSTEMS | |

It is a requirement of each contract for the contractor to plan, develop and maintain a documented Quality System in accordance with the Australian Standard for Quality Systems AS/NZS ISO 9002:1994 for registration for categories R2, R1, D1, S1, L1, P1, B2 and B1. Contractors must supply evidence of their commitment to quality and continuous improvement within their company. Submission of a copy of a recent internal, or preferably external, audit report of the company's quality system is required from all contractors seeking registration and pre-qualification for categories R2 or B2. The audit must have been conducted by a qualified auditor in accordance with AS 3911.1 Guidelines for Auditing Quality Systems ? Part 1: Auditing. The audit should be of a depth sufficient to provide evidence of the operation of the company's quality system as it would apply to Council's work. |

| OCCUPATIONAL HEALTH & SAFETY MANAGEMENT SYSTEMS | |

It is a requirement of each contract for the contractor to plan, develop and maintain a documented Occupational Health and Safety Management System in accordance with the Australian Standard AS4801 ? Occupational health and safety management systems ? specification with guidance for use for registration for categories R2, R1, D1, S1, L1, P1, B2 and B1. As a minimum, the contractor must meet the health and safety requirements set out in part 5.1 of the Occupational Health and Safety Regulations 2007 which commence on 1 July 2008. | ENVIRONMENTAL MANAGEMENT SYSTEMS | |

It is a requirement of each contract for the contractor to plan, develop and maintain a documented Environmental Management System ("EMS") for registration for categories R2, R1, D1, S1, L1, P1, B2 and B1. The system should be developed with reference to the Environmental Protection Authority's Publication No. 480 ? Environmental Guidelines for Major Construction Sites. As a minimum, the contractor?s EMS must address those matters set out in the Environmental Management System. The audit must have been conducted by a qualified auditor in accordance with AS 3911.1 Guidelines for Auditing Quality Systems ? Part 1: Auditing. The audit should be of a depth sufficient to provide evidence of the operation of the company's quality system as it would apply to Council's work. |
